Industrix, LLC ("Industrix," "we," "us," or "our") operates the Industrix marketplace platform, accessible at industrix.co and related subdomains (the "Platform"). This Privacy Policy describes how we collect, use, disclose, and safeguard your information when you visit our Platform, create an account, list a property, search for space, or otherwise interact with our services.

Please read this Privacy Policy carefully. By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by all the terms of this Privacy Policy. If you do not agree with the terms of this Privacy Policy, please do not access the Platform.

This policy applies to all users of the Platform, including landlords, property owners, tenants, contractors, brokers, and visitors. We are committed to protecting your personal information and your right to privacy. Information We Collect About You

We collect information you provide directly to us, information we collect automatically when you use the Platform, and information we receive from third parties. The categories of personal information we may collect include:

  • Account and contact information — your name, email address, phone number, and password when you create an account or contact us.
  • Business and professional information — your business name, business license number, entity type, years in operation, trade or contractor license, and intended use type provided as part of your Tenant Passport or landlord profile.
  • Listing and property information — details about spaces you list on the Platform, including address, square footage, asking rent, door height, power specifications, photos, and lease terms.
  • Transaction and payment information — billing address and payment method details processed through our third-party payment processor. We do not store full credit card numbers on our servers.
  • Communications — messages, inquiries, and other content you send through the Platform's messaging system or directly to us by email.
  • Usage and behavioral data — pages visited, search queries entered, listings viewed, features used, time spent on pages, and actions taken within the Platform.
  • Device and technical data — IP address, browser type and version, operating system, referring URLs, device identifiers, and general geographic location derived from IP address.
  • Preferences and settings — notification preferences, saved searches, alert configurations, and other optional settings you configure within your account.

How We Use Your Information

We use the information we collect to operate the Platform, provide our services, and improve your experience. Specifically, we use your information to:

  • Operate and maintain the Platform — create and manage your account, process subscriptions, display listings in search results, and facilitate direct communication between landlords and tenants.
  • Verify platform participants — validate business license information and use type disclosures as part of the Tenant Passport verification process to ensure qualified inquiries reach landlords.
  • Deliver alerts and notifications — send lease expiration alerts, new listing notifications, inquiry notifications, and account updates via email or SMS based on your preferences.
  • Provide market data and benchmarking — aggregate listing and transaction data to generate rent comp dashboards, vacancy rate reports, and corridor-level market intelligence for landlord subscribers.
  • Improve and develop the Platform — analyze usage patterns, diagnose technical issues, conduct research, and develop new features and services.
  • Communicate with you — respond to your inquiries, provide customer support, and send service-related announcements.
  • Marketing and promotional communications — send you information about new features, markets, or offerings, subject to your communication preferences. You may opt out at any time.
  • Comply with legal obligations — fulfill our obligations under applicable law, respond to lawful requests from public authorities, and enforce our Terms of Service.
  • Protect the Platform and its users — detect and prevent fraud, abuse, security incidents, and other harmful or unlawful activity.

Disclosure of Your Information

We do not sell your personal information to third parties. We may share your information in the following limited circumstances:

  • With other Platform users — when a tenant submits an inquiry on a listing, the landlord receives the tenant's business name, use type, and contact information as provided in their Tenant Passport. Landlords' names and contact details are shared with tenants who submit qualified inquiries through the Platform.
  • With service providers — we share information with vendors and service providers who perform services on our behalf, including cloud hosting (Supabase), payment processing, email delivery, and analytics. These parties are contractually bound to use your information only as directed by us.
  • For aggregated market data — we use aggregated, de-identified listing and transaction data to produce market reports and rent comp dashboards. This data cannot be used to identify individual users.
  • For legal and compliance purposes — we may disclose your information if required to do so by law, regulation, legal process, or governmental request, or to protect the rights, property, or safety of Industrix, our users, or the public.
  • In connection with a business transfer — if Industrix is involved in a merger, acquisition, reorganization, or sale of all or a portion of its assets, your information may be transferred as part of that transaction. We will notify you of any such change and any choices you may have.
  • With your consent — we may share your information for any other purpose with your explicit prior consent.

Data Security

We implement and maintain technical, administrative, and physical security measures designed to protect your personal information from unauthorized access, disclosure, alteration, and destruction. Our Platform infrastructure is hosted on Supabase, which provides encrypted data storage, secure connections (TLS/SSL), and industry-standard database access controls. Passwords are hashed and never stored in plaintext. Payment information is processed by PCI-DSS compliant third-party processors and is not stored on our servers.

Despite these measures, no security system is impenetrable and we cannot guarantee the absolute security of our systems. In the event of a data breach that affects your personal information, we will notify you as required by applicable law. You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account.

We retain your personal information for as long as your account is active or as necessary to provide you with our services, comply with our legal obligations, resolve disputes, and enforce our agreements. You may request deletion of your account and associated personal data by contacting us at legal@industrix.co.

Your State Privacy Rights

Depending on the state in which you reside, you may have certain rights with respect to your personal information. We serve users primarily in Washington, Idaho, and other states, and we are committed to honoring applicable state privacy rights as follows:

Washington residents (Washington My Health MY Data Act and Washington Privacy Act): You have the right to access personal data we hold about you, request correction of inaccurate data, request deletion of your data, obtain a copy of your data in a portable format, and opt out of any sale or sharing of personal data for targeted advertising. California residents (CCPA/CPRA): You have the right to know what personal information we collect and how it is used, the right to delete personal information we hold about you (subject to certain exceptions), the right to opt out of the sale of personal information (we do not sell personal information), the right to non-discrimination for exercising your privacy rights, and the right to correct inaccurate personal information. All users: Regardless of your state of residence, you may update or correct your account information at any time through your account settings, opt out of marketing emails by clicking "unsubscribe" in any email we send, and opt out of SMS notifications through your account preferences. We will respond to verifiable privacy rights requests within the timeframe required by applicable law.

Changes to Our Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. When we make material changes to this policy, we will update the "Last Updated" date at the top of this page and, where required by applicable law or where we determine notice is appropriate, we will provide you with additional notice — such as by sending an email to the address associated with your account or by displaying a prominent notice on the Platform prior to the change becoming effective.

We encourage you to review this Privacy Policy periodically to stay informed about how we are protecting the information we collect. Your continued use of the Platform after the effective date of any revised Privacy Policy constitutes your acceptance of the updated terms. If you do not agree to the updated Privacy Policy, you must stop using the Platform and may request deletion of your account.
